Rule 17
Termination of membership
: (1) According to clauses (b), (c) and (d) of sub-section (1) of section 34 of the Act, when the membership of a member is terminated, the following conditions must be fulfilled:-
(a) The information with the grounds for termination of the membership of the concerned member should be received in the organization or should be seen from the records of the organization,
(b) In relation to the termination of the membership of the concerned member, the Board of Directors should form a sub-committee and take an investigation report,
(c) Termination of membership - The sub-committee under Clause (b) should have given a reasonable opportunity to submit his/her excuse,
(d) There should be a decision of the Board of Directors regarding the termination of the membership of 8 concerned members.
(2) _A member who is not satisfied with the decision made by the board of directors according to clause (d) of sub-rule (1) may file a complaint with the registrar or an officer authorized by the registrar and the decision made by the registrar or an officer authorized by the registrar in this regard shall be final.
(3) Regardless of what is written in sub-rules (1) and (2), the organization shall give notice to its members to self-declare within three months from the date of commencement of this regulation, whether or not there is double membership in accordance with sub-section (1) of section 32 of the Act. (4) Based on the information received as per sub-rule (3), contrary to sub-section (1) of section 32 of the Act, in the case of a member who has dual membership, he shall retain the membership of the organization of his choice and terminate the membership of such member within the period prescribed in the Act of the other organization.
(5) Notwithstanding anything contained elsewhere in this rule, the Registrar or an officer authorized by the Registrar shall, by inspection or monitoring: in connection with: or by any other means, if any member is found to have dual membership contrary to sub-section (1) of section 32 of the Act, by maintaining the membership of only one organization of his choice. It can give instructions to cancel the membership of other organizations and according to the same instructions, the related organization has to terminate the membership of such member.
