Rule 145A
Establishment of Government Procurement Services Office

(1) Notwithstanding anything written elsewhere in this regulation, the Government of Nepal may establish a government procurement service office at the central level to assist the public bodies in the selection of suppliers and procurement of goods as per subsection (1) of clause (b) of section 2 of the Act.
(2) The public bodies in accordance with sub-section (1) of section (b) of section 2 of the Commodities Act, as specified by the Government of Nepal by publishing a notice in the Nepal Gazette, shall purchase from the suppliers selected by the office in agreement with the Government Procurement Service Office established as per sub-rule (1).
(3) The work of the office established as per sub-rule (1) shall be as follows:-
(a) To collect and negotiate purchase requests from public bodies as per clause (b) of subsection (1) of Section 2 of the Act, including details regarding the type, quality, quantity of goods, time when goods are required and budget arrangements,
(b) Analyzing the purchase demand, preparing the details (specification) of the purchase of the goods, preparing the cost estimate and preparing the documents related to the tender,
(c) inviting bids and selecting suppliers,
(D) Notifying the relevant public bodies to purchase according to the purchase conditions with the supplier.
(4) For the operation of government procurement services, the Public Procurement Monitoring Office shall issue separate procurement guidelines.
(5) Notwithstanding anything written elsewhere in this rule, nothing written in this rule shall prevent the purchase from the market if the market price is lower than the price determined by the office established under sub-rule (1).
