If, considering the crime committed by him, his age, the seriousness of the crime, the way he committed the crime, and his behavior, it is not appropriate to keep him in prison regularly, the court shall open him to prison only on the last day of the week or daily only at night time. He can determine the imprisonment to stay.
(2)_Notwithstanding anything contained in sub-section (1), sub-section of section 24
The offender who commits the offense mentioned in (3) shall not be punished according to this clause.
(3) The court may specify the conditions to be followed by the offender while determining the punishment under sub-section (1).
(4) If the offender kept in prison as per sub-section (1) complies with the conditions as per sub-section (3) and pays such period, he shall be deemed to have served such imprisonment while in prison.
(5) If the offender kept in prison according to sub-section (1) does not comply with the conditions of sub-section (3) or if he commits any offense punishable by imprisonment during such period, he shall serve the entire period of his imprisonment in prison.
