Section 18
Transferring Community Forests

(1) If a user group formed in accordance with Section 31 wants to organize any part of the national forest as a community forest in order to be able to determine the price and distribute the forest produce independently, it must submit an application to the Division Forest Office along with an action plan.
(2) The Divisional Forest Officer shall scrutinize and approve the action plan as per sub-section (1).
(3) If the action plan is approved as per sub-section (2), the Divisional Forest Officer shall issue a forest transfer certificate to the consumer group as per sub-section (1) in the prescribed format.
(4) For the purpose of sub-section (1), the Divisional Forest Officer may provide necessary technical and other assistance to form a consumer group and prepare an action plan with the participation of consumers.
(5) Based on the wishes and needs of the consumer group, the consumer group may make an action plan of the community forest in consultation with the relevant local level or revise it as needed to make the forest management work more effective. Before implementing the action plan made or amended in that way, the user group shall inform the Divisional Forest Officer.
(6) If it is found that the action plan or amendment made by the user group in accordance with sub-section (5) will have a significant adverse effect on the environment, the Divisional Forest Officer may instruct the user group not to implement such action plan or amendment within thirty days from the date of receiving information about such action plan or amendment and comply with such instructions. The consumer group will have a duty.
(7) The user group can conduct the forest enterprise and tourism programs as specified in the action plan approved by the Division Forest Office.
(8) According to sub-section (7), the consumer group may use the forest area as specified for tourism development.
(9) The consumer group may give any part of the community forest to the consumer below the poverty line for earning income by using and developing the community forest.
