Section 50
Punishment
(1) A person who commits or causes an offense under clause (a) of section 49 shall be punished with imprisonment for a term which may extend to five years or with fine which may extend to fifty thousand rupees or with both.
(2) Whoever commits an offense under clause (b) of section 49 shall be punished with imprisonment for a term which may extend to one month or with fine which may extend to one thousand rupees or with both.
(3) Whoever commits an offense under Clause (c) of Section 49 shall be punished with imprisonment for a term up to five years or a fine of up to one lakh rupees or both and such land shall be included in the National Forest and the house or hut built on that land and the machinery and tools used shall be confiscated. If he has removed or damaged the forest produce while committing such an offense, he will also be punished accordingly.
(4) Whoever commits an offense under Clause (d) of Section 49 shall be punished with imprisonment for a term up to three years or with a fine up to sixty thousand rupees or with both.
(5) A person who commits an offense under clause (e) of section 49 shall be fined at the following rate for each quadruped:-
(A) - In case of sheep and goats, fifty rupees to five hundred rupees,
(b) In case of elephants, from one thousand rupees to five thousand rupees,
(c) In case of other quadrupeds, from one hundred rupees to one thousand rupees.
(6) Whoever commits an offense under clause (f) (g) (h) (j) or (h) of section 49 shall be punished as follows by confiscation of the forest produce related to the offence:-
(a) Fine up to one thousand rupees for default up to one thousand rupees,
(b) Imprisonment for up to one month or fine or both, in case of breach from one thousand rupees to five thousand rupees,
(c) Imprisonment for up to three months or fine or both in case of breach of five thousand rupees to fifty thousand rupees,
(d) Imprisonment for up to six months or fine or both, in case of breach of rupees fifty thousand to rupees one lakh,
(e) Imprisonment for a term which may extend to one year, or with fine, or both, in default of rupees one lakh to rupees five lakhs,
(f) Imprisonment for a term which may extend to two years or with double fine or with both, irrespective of the default, exceeding five lakhs of rupees.
(7) The forest produce related to the offense shall be confiscated from the offender under Clause (k) of Section 49.shall be punished with imprisonment for a term which may extend to three years or with fine twice thereover or with both.
(8) Whoever commits an offense under clause (l) or (d) of section 49 shall be punished with imprisonment for a term which may extend to one year or with fine which may extend to twenty thousand rupees or with both.
(9) Whoever commits an offense under clause (d) of section 49 shall be fined up to five hundred rupees per plant and whoever commits the same offense again shall be punished with imprisonment up to one year or fine up to twenty thousand rupees or both depending on the amount of the offence.
(10) Whoever commits an offense under clause (n) of section 49 shall be punished with imprisonment for a term which may extend to six months or with fine which may extend to ten thousand rupees or with both.
(11) Whoever commits an offense under Clause (a) of Section 49 shall be punished according to the prevailing law related to wildlife protection.
(12) Whoever commits an offense under Clause (th) of Section 49 shall be fined up to two lakh rupees in addition to the punishment for such offence.
(13) Whoever commits an offense under clause (d) of section 49 shall be punished with imprisonment for a term which may extend to one year or with a fine which may extend to twenty thousand rupees or with both.
(14) Whoever commits an offense under clause (d) of section 49 shall be punished with imprisonment for a term which may extend to six months or with a fine which may extend to ten thousand rupees or with both.
