Rule 5
Remove from list
(1) Section 6b of the Act. Any person, group or organization listed under may submit an application to the Ministry in the format as per Schedule-2 to remove their name from the list along with the grounds and reasons why their name should not be included in the list. But section 29 of the Act. The person, group or organization included in the list should submit such application to the Ministry through the Ministry of Foreign Affairs.
(2) If an application is received in accordance with sub-rule (1), the Ministry shall carry out necessary investigations as follows:-
(a) Whether or not the applicant's name matches the address list,
(b) Whether or not the applicant is related to the subject of the list.
(3) If the Ministry does not find that the applicant should be included in the list during the investigation according to sub-rule (2), it shall be submitted to the Government of Nepal, Council of Ministers for a decision along with the basis and reason thereof.
(4) According to sub-rule (3), if the Government of Nepal, the Council of Ministers decides to remove the name of any person, group or organization from the list, the Ministry shall do as follows:-
(a) If the applicant is included in the list according to section 29B of the Act, to send his name in writing to the relevant body of the United Nations through the Ministry of Foreign Affairs to remove his name from the said list,
(b) As requested by the petitioner from any country, Section 29f of the Act. If he is listed in the list according to sub-section (3), his name will be removed from the list and the information will be given to the concerned country through the Ministry of Foreign Affairs. (c) The petitioner was notified by the Government of Nepal itself under section 29f of the Act. If it is listed in the list according to sub-section (3), to remove it from the list,
(d) If the applicant has been listed by a foreign country at the request of the Government of Nepal, send it in writing to the concerned country through the Ministry of Foreign Affairs.
(5) Notwithstanding anything contained elsewhere in this rule, the name of any person, group or organization referred to in section 29N of the Act. and 29h. If it is found that the name of any person, group or organization that should not be included in the list has been listed, the Ministry shall remove the name of such person, group or organization from such list and the assets or funds of such person, group or organization have been withheld.A should also be released immediately.
(6) If any person, group or organization is removed from the list in accordance with clauses (b) and (c) of sub-rule (4) or sub-rule (5), the Ministry shall immediately publish the notice on its website.
(7) Ministry of the Act Section 29n., 29ch. Or shall make arrangements to regularly review the persons, groups or organizations listed in accordance with this regulation to determine whether they will remain in the list in accordance with the Act or this regulation.
