Section 101
Punishment by court martial

(1) The following punishments can be given by military court:-
(a) Imprisonment of birth,
(b) …………
(c) Imprisonment for a term which may extend to 14 years,
(d) To remove him so that he will not be disqualified for future government service or to dismiss him so that he will be disqualified for future government service,
(e) Downgrading,
(f) Withholding promotion for five years,
(g) Deduction of salary up to three months for offenses committed in military action
(h) Withholding salary allowance until compensation is made,
(j) To suspend salary increment for a maximum period of two years,
(j) Giving advice,
(2) If the following offense is committed, the punishment will be as follows:-
(a) If an offense is committed under clause (a) of sub-section (1) of section 38, 39 and section 42, the punishment will be life imprisonment.
(b) If he commits the following offence, he will be imprisoned for up to fourteen years:-
(1) In case of committing an offense under Section 40,
(2) If he commits an offense under clause (a) of section 41 and 45 while engaged in military action,
(3) If he knowingly commits an offense under section 43 or 46,
(4) If any officer committing an offense under clause (a) or (b) of section 44 while performing his duty while engaged in military action,
(5) If he commits an offense under section 47.
(c) If he commits the following offence, he will be punished with imprisonment up to ten years:-
(1) If an officer commits an offense under clause (a) or (b) of section 44 while not engaged in military action,
(2) In case of committing an offense under Section 48, 49 or Section 50,
(3) In case of committing an offense under Clause (a) of Section 51 or Clause (a) of Section 52, (d) If he commits an offense under clause (b) of sub-section (1) of section 42, he will be punished with imprisonment up to seven years.
(e) If he commits the following offence, he will be imprisoned for up to seven years:-
(1) If an offense under section 41 is committed while not engaged in military action,
(2) If he commits an offense under section 46 without knowing it,
(3) If he commits an offense under clause (b), (c), (d), (e), (f) or (g) of section 52, (4) In case of committing an offense under Section 53, 54 or Section 63.
(f) If he commits the following offence, he will be imprisoned for up to five years:-
(1) If he commits an offense under clause (c) of section 44,
(2) JangiIf he commits an offense under clause (a) of section 45 while not taking action,
(3) If he commits an offense under clause (b) or (c) of section 51 or section 55, 56 or section 57,
(g) If he commits an offense under clause (c) or (d) of sub-section (1) of section 42 or section 58, 59 or section 60, he will be punished with imprisonment up to three years.
(h) If he commits the following offence, he will be punished with imprisonment up to two years:-
(1) If he commits an offense under clause (e), (f), (g) or (h) of sub-section (1) of section 42,
(2) If an offense is committed under clause (b) of section 45,
(3) If a person below the rank of an officer commits an offense under clause (h) of section 52 during military action and performance of duty,
(4) If he commits an offense under section 43 without knowing it,
(5) If he commits an offense under section 61.
(i) If a person below the rank of officer commits an offense under Section (h) of Section 52 during military action and duty, he shall be punished with imprisonment for up to 6 months.
(j) If he commits an offense under clauses (j) and (j) of section 52, he will be dismissed from service.
(k) In case of committing an offense under Clause (k) of Section 62, two salary increments will be suspended or promotion will be suspended for two years.
(l) If it is determined by the military court that he has committed the offense mentioned in paragraph-7 or has attempted to commit such an offence, he shall be punished as follows except for the provisions of this Act:-
(1) Imprisonment for up to fourteen years for committing an offense punishable by life imprisonment and imprisonment for up to half of the upper limit of imprisonment for the offense committed, for committing any other offence,
(2) If an offense is committed, the punishment for the offense committed shall be equal to the offence,
(3) Imprisonment for up to fourteen years for those who attempted to commit an offense punishable by imprisonment for life but failed to commit the offense and for those who attempted to commit other offenses but failed to commit the offense, imprisonment for up to half of the upper limit of imprisonment for the offense committed.
(3) According to clause (a) of sub-section (1) of section 42, if the person who commits the offense is not found or does not appear within thirty-five days from the date of absconding, his share shall be withheld. If such person does not appear for three years or is not found even after searching, his share will be confiscated and auctioned.The amount received will be deposited in the government treasury.
(4) If the offender is found after confiscating the portion according to sub-section (3), life imprisonment can be imposed.
(5) In accordance with Clause (j) of sub-section (2), any person who has been dismissed for the purpose of being disqualified for government service in the future shall not be given any other benefits including his remaining salary allowance and pension, apart from the amount accumulated in the reserve fund.
