(1) The public body should ensure the following before direct purchase:-
(a) Whether the goods to be purchased are in stock or not,
(b) Whether the proposed builder, supplier, consultant or service provider has the necessary qualifications to perform the performance as per the purchase agreement,
(c) Whether or not the proposal submitted by the proposed builder, supplier, consultant or service provider as per the request of the public body is in accordance with the specifications and technical quality determined by such body, and
(d) Whether the price offered by the proposed builder, supplier, consultant or other service provider is reasonable or not.
(2) In order to ascertain whether the price as per sub-rule (1) - (d) is reasonable, the public body may negotiate with the proposed builder, supplier, consultant or other service provider after analyzing the rate based on market study, pre-purchase price, cost estimate. .
(3) Pursuant to sub-section (3) of section 41 of the Act, the purchase agreement can also be done through correspondence.
