When the court orders to keep a disabled senior citizen who has been sentenced to imprisonment or a senior citizen who has completed seventy-five years of age in a care center according to sub-section (3) of section 12 of the Act, the following points should be considered:-
(a) Misdemeanor and intention, cause and circumstances of the offence,
(b) His past conduct,
(c) his age and physical condition,
(d) His statement regarding the offense and his apology for the offence,
(e) Other relevant matters
