Rule 42
Public Participation
(1) In the cost estimation of the project construction, the consumer shall bear the part of the investment as per schedule-4. …………
(1a) Notwithstanding anything written in sub-rule (1), the consumer investment figure for new construction and strengthening of medium irrigation projects and small irrigation projects other than new technology based irrigation systems and underground water irrigation systems shall be more than fifteen percent and less than three percent of the project cost. no However, in order to reduce the impact of unexpected natural disasters such as drought, floods, landslides, and famine, special irrigation programs should be conducted by the government in such areas with full investment.
(2) The concerned consumer shall hand over the land needed for the culvert or culvert to be constructed for the purpose of conveying water to the land of the consumer from the canal, branch canal or branch canal of any irrigation project constructed by the Government of Nepal.
(3) In accordance with sub-rule (2), the information about transfer of land should be given to the concerned irrigation office and the irrigation office should take action for the transfer of land and property.
(4) According to sub-rule (3) the prevailing value of the land transferred shall be maintained and adjusted to the amount to be spent by the concerned consumer as per sub-rule (1). (5) Farmers who need land for the construction of Kulo Kuleso but who do not get irrigation facilities will have to pay the amount equal to the value of the land according to the prevailing rate from the collected funds of the consumer organization.
(6) Notwithstanding anything written in this rule, the construction work of the culvert or cullet shall not be started until it is certain that the funds as per sub-rule (1) have been raised.
