Section 2
Definition
In this Act, unless the subject or context otherwise requires,–
(a) "Notary Public" shall mean a person who has obtained the certificate of Notary Public in accordance with Section 14.
(b) "Council" means the Nepal Notary Public Council established as per section 3.
(c) "Chairman" means the Chairman of the Council.
(d) "Member" means a member of the Council and the term includes the Chairman.
(e) "Secretary" means a person appointed or appointed under section 7.
(f) "Certificate" means the certificate issued as per section 14 to act as a notary public.
(g) "Instrument" means any document between two or more persons creating, transferring, amending or extending any kind of right or obligation, and by that term, a prescribed document used abroad or a document containing true details to be submitted to the court of origin. (Affidavit) or other similar documents or documents.
(h) "Document" means a document issued by a government or public office or a private organization and the term also refers to a document.
(i) "Certification" means the act of certifying a document by a notary public in accordance with section 27.
(j) “Representative” means the following person:-
(1) A person who has been authorized to authenticate a document in accordance with the prevailing law, or (2) A person authorized to sign a document on behalf of a firm, company or organized organization established in accordance with prevailing laws.
(k) "Law practitioner" means a person who is registered as a law practitioner according to the prevailing law.
(l) "Prescribed" or "as prescribed" means prescribed or prescribed in the rules made under this Act.
