Section 2
Definition
In this Act, unless the subject or context requires otherwise,-
(a) "Asymmetric cryptosystem" means a system for generating a secure pair of keys consisting of a private key for creating a digital signature and a public key for verifying a digital signature.
(b) "Licence" means the license obtained under sub-section (3) of section 18.
(c) "Originator" means a person who generates, collects or transmits an electronic record and the term also refers to a person who causes any other person to do such work. But that word does not refer to an intermediary (intermediary).
(d) "Computer" means an electromagnetic, visual or other high-speed data processing device or system that performs logical, arithmetical and memory operations by utilizing electromagnetic or visual impulses, and the term refers to any computer system or computer in a computer network. (k) "Data" means a presentation of information, knowledge, facts, concepts or instructions in any form formally prepared and stored or processed in a computer system or computer network for the purpose of processing or stored in the memory of a computer.
(l) "Tribunal" means the Information Technology Tribunal constituted under section 60.
(d) "Private Key" means one key of a pair of keys used to create a digital signature.
(l) "Controller" means the controller appointed or designated as per section 13.
(n) "Digital signature" means an electronic signature that involves the conversion of an unaltered initial electronic record and an electronic record using an asymmetric cryptosystem such that a person possessing the public key of the signatory can accurately determine the following:-
(1) Whether or not the transformation of the electronic record was created using a private key consistent with the signer's public key, and
(2) Whether or not the original electronic record has been changed since the conversion of the electronic record.
(i) "access" means gaining access to, directing to, or accessing the logical, arithmetic or memory properties of any computer, computer system or computer network;C Communication should be an opportunity to contact.
(h) "Appellate Tribunal" means the Information Technology Appellate Tribunal constituted under section 66.
(d) "Certificate" means the digital signature certificate issued by the certifying body in accordance with section 30.

(N) "Certifying Authority" means a validating authority licensed under sub-section (3) of section 18 to issue digital signature certificates.

(f) "Electronic record" means data, record, image or sound created and transmitted, received or collected by any means of electronic form.

(v) "Government body" shall mean the ministry, secretariat, department or office under it, constitutional body or office under it, court or tribunal or the office of the Nepalese army and the term also refers to other offices of the same nature.
(h) "Public Institution" means the following institutions:-
(1) Companies, banks or committees wholly or partially owned or controlled by the Government of Nepal or commissions, institutions, authorities, corporations, foundations, boards, centers, councils and other organizations of a similar nature established by the Government of Nepal in accordance with prevailing laws,
(2) Universities, schools, research centers and other similar academic or educational institutions run by the Government of Nepal or fully or partially subsidized by the Government of Nepal,
(3) Local bodies formed in accordance with the Local Self-Government Act, 2055,
(4) Institutions running on loans, grants or guarantees from the Government of Nepal,
(5) An organization wholly or partially owned or controlled by an organization mentioned in sub-section (1), (2), (3) or (4), or receiving a subsidy from such an organization,
(6) Other organizations designated as public organizations by the Government of Nepal by publishing a notice in the Nepal Gazette.
(f) "Prescribed" or "as prescribed" means prescribed or prescribed in the rules made under this Act.
