Section 3
Privacy of individual's physical and private life
(1) The confidentiality of the matter relating to the physical and mental condition of every person shall be inviolable.
(2) The subject of physical privacy of any person shall be inviolable without the consent of the person concerned except in the case of examination, treatment or emergency rescue operation of his body or health.
(3) Any person shall have the right to maintain the privacy of matters relating to his private life such as biological or genetic identity, gender identity, sexuality, sexual relations, conception or abortion, virginity, virility, sterility or physical illness.
(4) No one shall publish or cause to be made public by writing, speaking, publishing or using electronic means or in any other manner, any matter referred to in sub-section (3) relating to such person in such a way as to affect, shock or insult the private life of any person. .
(5) Notwithstanding anything contained elsewhere in this section, the privacy of a person's physical or mental condition or private life may be disclosed in the following cases:-
(a) In the case of a matter with the consent of the person concerned,
(b) If the matter has been voluntarily made public by the person concerned,
(c) if the subject of an investigation in connection with an offense by the investigating or prosecuting authority,
(d) in case the physical condition or private life of the subject or person referred to in sub-section (3) is required to be disclosed in order to obtain any facility or concession, if he obtains or wishes to obtain such facility or concession.
