: (1) The Government of Nepal shall appoint the Chairman and members of the Commission on the recommendation of the following committee:-
(a) Secretary, Ministry – Coordinator
(b) One electrical expert nominated by the Ministry - member
(c) Gazetted First Class Officer-Member-Secretary
designated by the Ministry (2) For the purpose of recommending candidates for the appointment of the chairman and members, the committee as per sub-section (1) shall publish a public notice giving a deadline of at least fifteen days to the interested candidates to submit their personal details along with the application.
(3) The committee as per sub-section (1) shall recommend to the Government of Nepal within twenty-one days of the expiry of the application deadline the name of the person deemed suitable from among the candidates applying as per sub-section (2). When making such a recommendation, in the case of a member, the name of a person from a different subject as per Clause (b) of Section 5 shall be recommended. But if sufficient candidates from different subjects are not available, more than one person from the same subject can be recommended.
(4) The meeting of the committee as per sub-section (1) shall be chaired by the coordinator of such committee and if the coordinator and one member are present, the quorum for the meeting of the committee shall be deemed to have been reached.
(5) In the meeting of the committee as per sub-section (1), the opinion of the majority shall be valid and in case of equality of votes, the person presiding shall cast the deciding vote.
(6) The basis for recommending candidates for the chairman and members, the process and other procedures related to the meeting shall be as determined by the committee itself.
(7) The meeting allowance of the coordinator and members of the committee as per sub-section (1) shall be as prescribed by the Ministry of Finance.
