Rule 60
Study Leave
(1) Soldiers who are selected in an open competition or nominated by the Government of Nepal to study on a foreign scholarship received by the Government of Nepal on subjects useful and necessary to the Nepalese Government will receive study leave throughout the study period.
(1a) A scholarship received from a university in the country or any study institution or faculty under it in any subject that is useful and necessary for the Nepali Army or nominated for study at the expense of the Government of Nepal in Kotama, if recommended by the Nepali Army and approved by the Ministry, a military person can be given study leave for the duration of the study period.
(2) A military person will get study leave for three years once or several times during the service period. But the government of Nepal can extend the period of study leave up to two years if it deems it necessary.
(3) Notwithstanding anything written in sub-rule (2), a military person who has been nominated for a study and has taken a study leave will not be given a re-approval and study leave for the purpose of studying additional subjects or obtaining additional titles without completing the studies and appearing in the service. > (4) Soldiers on study leave will receive full pay.
(5) No military person will get study leave before completing three years of military service.
(6) A military person who is on study leave before going to study, who has completed such study and returned, must make a confession to serve in his service for the following period in the format as per schedule-11:- Period of study Minimum period to be served
(a) Three months to one year
(b) Three months to six months and one and a half years (c) Six months to nine months Two years
(d) From nine months to one year Three years
(e) From one year to two years Four years
(f) From two years to three years to five years (g) Three years to four years to seven years (h) Four years to five years eight years
(7) If a military person does not serve for the period mentioned in sub-rule (6) after completing his studies, the salary received from such a military person throughout the study period and other amounts mentioned in the confession will be charged as government dues.
(8) On the recommendation of the head of the department to study the related service of the Nepalese Army on a subject that is useful and necessary, after taking the prior approval of the Government of Nepal, a military person who is going to study at home or abroad on a private effort may be given study leave according to sub-rule (2). A military person requesting such leave must get approval before applying.
(9) Notwithstanding anything written in sub-rule (4), a soldier who is on study leave in accordance with sub-rule (8) shall not receive salary for the period of study leave.
(10) Military personnel who have taken study leave to study in an educational institution shall not be allowed to change that educational institution without prior approval. In this way, if he changes the educational institution or if he does not study in that educational institution, his study leave will be canceled automatically. In this way, the details of cancellation of leave should be sent by the concerned office to the concerned department and military archives.
(11) Once paid study leave has been approved as per sub-rule (8) for study in accordance with this rule, the period of that leave shall not be converted into paid study leave.
(12) According to sub-rule (8), the period during which a person is on study leave shall be counted as service period.
(13) A military person who has taken study leave for one level of study after returning to military service will not be granted approval and study leave for the same level of study without completing the service period as per sub-rule (6). After completing the service period as mentioned above, study leave should be given for the same levelStudy leave can be granted only for the study of a subject different from the subject.
(14) Once a military person who has gone on study leave can be granted study leave again only if he submits the certificate of the rank for which he has taken study leave.
