Rule 21
Other public prosecutors can perform the work of an absent public prosecutor
(1) In the event that any public prosecutor is absent from the public prosecutor's office or his position is vacant, any public prosecutor of that office can do the work that is to be done by such a public prosecutor according to this regulation, as determined by the senior public prosecutor of the office.
(2): In the event that a public prosecutor of a subordinate office is absent or his/her position is vacant, a public prosecutor designated by the head of a higher-level public prosecutor's office may perform the work required of such a public prosecutor according to this regulation.
(3) In the event that a public prosecutor working in a public prosecutor's office or body is absent or the position is vacant, the office of the attorney general or the head of the relevant higher public prosecutor's office within its territorial jurisdiction may prescribe that the work to be performed by such a public prosecutor under this regulation shall be performed by a public prosecutor from another office. .
(4) Notwithstanding anything written in sub-rules (1), (2) and (3), the Office of the Attorney General may, in special circumstances, appoint a public prosecutor at any level to file a case or argue a case on behalf of the Government of Nepal in any government office. .
(5) It shall be the duty of the public prosecutors and employees of the concerned public prosecutor's office to assist the public prosecutor appointed in accordance with sub-rule (4).
