Section 8
Investigating and gathering evidence

(1) If any offense mentioned in schedule-1 is received, the concerned police office shall appoint a police officer of at least the rank of Deputy Inspector of Police as an investigation officer as soon as possible and inform the relevant public prosecutor's office and the police office above him as soon as possible, and the investigation so appointed shall be done. The officer should investigate such offence. But to investigate the following offences, at least an officer of police inspector rank should be appointed:-
(a) Section-1, Section-12, Section-17, Section-18, Section-219 of Section-19, Section-230, 231, 232, 233, 235, 238, Section-20 of Section-20 of Part-2 of the Criminal Code 244, Sections 256, 257 and 258 of Chapter-22,
(b) Offenses related to narcotics, human trafficking and smuggling and foreign exchange,
(c) Other offenses specified by the Government of Nepal after considering the seriousness of the offense by publishing a notice in the Nepal Gazette.
(2) The investigation officer shall prepare a crime scene report by revealing the following written information as far as possible in order to accurately describe the crime and the place where the crime took place during the investigation in accordance with this section:-
(a) the date and time of the offence,
(b) the address, description and diagram of the place where the offense occurred,
(c) the facts of such place and its relation to the offender or offender,
(d) Ten evidence seen or found at or around the place where the offense was committed and any other significant matter related to the offence.
(3) When the investigating officer prepares the crime scene warrant in accordance with sub-section (2), he shall surround such place as much as possible so that no other person can enter such place and any palm and finger or footprints seen or found in such place, mark or other evidence or crime shall be used to help in establishing the crime. You can also take a photo of any other important thing.
(4) According to sub-section (2), during the preparation of the crime scene bond, if the offender or the accused person is present, his/her finger print and identification details shall also be taken.
(5) The Investigating Officer shall inquire into any tenets relating to the offenceIf any value, item or object is found, it should be taken into possession.
(6) According to sub-section (5), the officer who takes possession of the goods or objects of the tenancy shall give the compensation to the concerned person.
(7) If an officer is designated by the law to investigate the offenses mentioned in schedule-2, the investigation shall be conducted by the same officer, and in case such officer is not appointed, the investigation shall be conducted by the relevant chief district officer or the officer-level employee designated by him.
(8) The officer designated as per sub-section (7) shall complete the procedure mentioned in sub-section (2), (3), (4), (5) and (6) while investigating such offence.
(9) When investigating a single incident according to this paragraph, all the cases that may arise from such an incident shall be investigated at once.
