Section 2
Definition
In this Act, unless the subject or context requires otherwise,-
(a) "Court" shall mean the Supreme Court, High Court or District Court and the term shall also refer to any other court, judicial body or officer authorized by law to process, hear and dispose of certain types of criminal cases.
(b) "Investigating Officer" shall mean an officer appointed or authorized by law to conduct an investigation in relation to any offense in accordance with this Code and the term also refers to an investigation team formed to conduct an investigation in relation to a particular offence.
(c) "Criminal Code" means the Civil Offenses (Code), Code 2074.
(d) "Complaint" means a complaint to be filed in the court and the term also refers to the indictment in relation to the offenses under Schedule-1 or Schedule-2 and the related report in relation to other cases.
(e) "Offence" means an act punishable under the Criminal Code or other laws.
(f) "Law" means the law in force for the time being.
(g) "serious offence" means an offense punishable by imprisonment for a term exceeding three years up to ten years.
(h) "Heinous offence" means an offense punishable with imprisonment for life or imprisonment for more than ten years.
(i) "Place" shall mean a house, a tower, a shed, a scaffold or a tent and the term shall also refer to a vehicle, boat, aircraft and other places or means of a similar nature.
(j) "Judge" means the officer of the court who conducts, hears and disposes of cases and the term also refers to the officer authorized to conduct, hear and dispose of criminal cases.
(k) "Police Office" means the Police Office authorized to investigate the offenses mentioned in Schedule-1.
(l) "Criminal case" means a case related to an offense under Schedule-1, Schedule-2, Schedule-3 or Schedule-4 and the term also refers to any case other than the following:-
(1) Article relating to legal rights, status, position, family relationship or propertyDa,
(2) Relation or divorce,
(3) Fees, wages, salaries, allowances or wages,
(4) Ansh, aputali, donation box, will, guardian, matthwar, matrik, patrika, akhti, adoptee or adoptee,
(5) any claim under any contract, quasi-contract or improper enhancement,
(6) Rights or claims related to malfeasance, quasi-malfeasance or defective products,
(7) Facilitation,
(8) Indemnification, or
(9) Any other rights or obligations of a civil nature.
(d) “case” means a criminal case (d) "Trial Officer" means an officer authorized by law to process, hear and dispose of a case, and in the case of a detained person, the term also refers to the court nearest to the place of detention.
(n) "Local level" means rural municipality or municipality.
(s) "Government Attorney" means the Attorney General, Deputy Attorney General, Associate Attorney, Deputy Attorney, District Attorney or Assistant District Attorney and the term also refers to an officer appointed by the Attorney General to act as a Government Attorney.
