Notwithstanding anything contained in section 21, an employee may be transferred before completion of term in the following cases:-
(a) If the Medical Board constituted by the Government of Nepal recommends that an employee is unable to work at any location due to physical or mental illness,
(b) If departmental action is taken against any employee,
(c) If the post is reduced and the employee working in that post falls into disuse,
(C1) If any employee has to be given special responsibility,
(d) Rural health workers, Ayurvedic health workers and maternal and child workers on the basis of mutual agreement or on the basis of the demand of the employees if such posts are vacant in any office.
