Section 48
Pension
(1) An employee who has been reinstated in the health service for twenty years or more will receive monthly severance pay as follows:- total years of service x amount of last salary 50 but-
(1) An employee dismissed from the service for the purpose of future health service will not be entitled to pension according to this clause.
(2) If it is proven that the citizenship, age or qualification has been falsified for the purpose of remaining in the health service or obtaining such service, such employee will not be given pension and will be punished according to the prevailing law.
(2) Notwithstanding anything contained in sub-section (1), the minimum amount of pension shall not be less than half of the starting scale of pay of an employee holding the same post and the maximum shall not exceed the starting scale of the employee holding the same post.
(3) According to the Civil Service Act, 2049, if an employee who has been reinstated in the Nepal Health Service and has been transferred to the health service in accordance with this Act retires after completing the term of office in accordance with Section 19, the total service of such employee shall be added to the period remaining until the age of sixty years. The period will be fixed.
(3a) In case of death of an employee who has completed fifteen years of service and not yet reached twenty years of service, his family will be allowed to choose whichever pension or gratuity they wish to receive by adding a maximum of five years to his service period.
(4) If a person who is receiving pension due to his previous service in a government position is later appointed to a health service position, he will be entitled to receive pension for the previous service period in accordance with this section.
(5) If an employee who has been appointed to the post of General Staff before the 14th of June 2054 wants to take pension, he will be given a pension by adding the service period required for pension from the service period of his development.
