Section 3
Formation of Commission Formation of Commission

(1) To investigate and investigate the truth about the serious violation of human rights during the armed conflict and the people involved in such incidents, to bring the real facts to the public, to reconcile between the perpetrators and the victims, and to arrange compensation for the victims, and to prosecute the persons involved in serious crimes related to such incidents. The Government of Nepal will publish a notice in the Nepal Gazette and establish an independent, impartial, accountable and high-level Commission of Inquiry on Disappeared Persons and a Truth and Reconciliation Commission for recommending action.
(2) There will be at least one woman in the commission including five members including the chairman.
(3) There will be a recommendation committee as follows to make recommendations for the appointment of the chairman and members:-
(a) A person appointed by the Government of Nepal from among the former Chief Justices - Chairman
(b) Chairman of the National Human Rights Commission or a member of the commission appointed by him (c) Three members, including at least one woman, nominated by the Government of Nepal from among human rights activists, psychologists, lawyers, jurisprudents, conflict experts, sociologists, women's rights activists or people involved in the peace process. (4) The recommendation committee under sub-section (3) shall recommend the names of the chairman and members from among the persons who are qualified to be the chairman and members in accordance with this Act.
(5) Before recommending the names of the chairman and members, the recommendation committee according to sub-section (3) shall determine their public selection process and publish such selection process publicly.
