Rule 5
Licensor

(1) Upon examination of the application received in accordance with Rule 4, if it is found that the applicant has fulfilled the following requirements, the Ministry will issue a license to operate the tourism business in accordance with Schedule-2, after taking a fee of five thousand rupees from such a tourism professional. (a) Having at least two vessels in the name of the cruise operator,
(b) Having protective equipment and materials of the quality specified by the Ministry to operate the cruise business,
(c) Completed other matters specified by the Ministry from time to time.
(2) The Ministry will form a five-member committee including representatives of the relevant sectors to check whether the protective equipment and materials mentioned in clause (b) of sub-rule (1) are in accordance with the quality specified by the Ministry and submit a report to the Ministry.
(3) The rating agencies that have been registered and operating with the Nepal Government before the commencement of this regulation shall be able to obtain a license in accordance with this regulation within one year of the commencement of this regulation.
(4) A yachting agency that has not been able to obtain a license within the period specified in sub-rule (3) shall obtain a license within one year from the date of commencement of this rule.
