Section 9
Can cancel license
: (1) The department may cancel a license granted under this Act in any of the following cases –
(a) If it is found that a license has been obtained by submitting false documents or particulars,
(b) If the paid-up capital is not increased within the specified period as per the order given by the department in accordance with section 7 or if no additional bond is filed, (c) if the business is carried on in contravention of section 11,
(d) If the business is conducted without an agreement in accordance with section 14,
(e) If the compensation to be given to the consumer according to section 23 is not given within the specified period,
(f) If the fine due under section 24 is not paid within three months,
(g) If within a period of two years, for the third time, he commits an act punishable under section 24,
(h) In case of doing any other act contrary to this Act or the rules made under this Act.
(2) Before canceling the license according to sub-section (1), the department shall give a reasonable opportunity to the concerned licensee to present his justification.
(3) The party who is not satisfied with the decision of the department to cancel the license according to sub-section (1) may file an appeal in the relevant high court within thirty-five days from the date of receiving the information of the decision to cancel such license.
