: (1) A person who commits or commits the following offenses shall be punished as follows depending on the amount of the offense –
(a) A person who commits an offense under Clause (a) or (d) of Section 36 shall be fined as per the above if the bag is opened and if the bag is not opened, a fine of one lakh rupees to five lakh rupees or imprisonment from six months to one year or both,
(b) A person who commits an offense under Clause (b) of Section 36 shall be liable to a fine of Rs.500,000 to Rs.10,000,000 to a fine of Rs.500,000 to Rs.10,000,000 or to imprisonment for three to five years or both, (c) A person who commits an offense under Clause (c) of Section 36 shall be fined as per the above if the bag is opened and if the bag is not opened, a fine of up to one lakh rupees or imprisonment up to three years or both,
(d) A person who commits an offense under clause (e) of section 36 shall be punished with a fine up to fifty thousand rupees or imprisonment for a term up to three months or both.
(2) If a company with a license according to this Act commits an offense under Section 36, the founder, director or relevant officer of the company who commits such offense shall be punished as per this Section.
(3) A licensee or person who commits an offense under section 36 who becomes drunk or encourages such an offense shall be punished with half of the punishment for committing such an offence.
