Section 10
Cannot operate foreign employment business without license
: No one shall be allowed to operate foreign employment business without obtaining a license according to this Act. 11. Licensing Provisions:
(1) An organization that wants to operate foreign employment business shall submit an application to the Department for a license with the prescribed details. "(2) If it is deemed appropriate to issue a license to conduct foreign employment business upon the necessary examination of the application submitted under sub-section (1), the license fee as specified by the department and a deposit of five million rupees in cash with the organization requesting the license with the goal of sending up to three thousand workers annually and A bank guarantee of one crore fifty lakh rupees, one crore rupees in cash for the guarantee from the organization seeking license with the aim of sending more than three thousand to five thousand workers annually and a bank guarantee of three crore rupees and two guarantee from the organization seeking license with the aim of sending more than five thousand workers annually. One million rupees in cash and a bank guarantee of four million rupees will have to be given permission." "(3) The organization that obtained the license before the commencement of sub-section (2) shall file the bond amount and bank guarantee within six months from the date of commencement of that subsection."
(4) After obtaining a license by depositing a bond in accordance with sub-section (2), if the bond appears to be insufficient in proportion to the business of the licensee, the department will order the filing of additional bonds as necessary.
(5) The department may accept bank guarantee for the additional bond to be filed as per sub-section (4).
(6) If the license cannot be granted after examining the application in accordance with sub-section (2), the department shall provide the applicant with information including reasons within seven days of the decision not to grant the license.
(7) The applicant who is not satisfied with the decision made by the department according to sub-section (6) may file an appeal before the "Ministry" within thirty-five days from the date of receiving such information and the decision made by the Government of Nepal regarding that appeal shall be final.
