Section 4
Provisions relating to Registration of Use

(1) A person, firm or company wishing to establish the following industries in accordance with this Act shall submit an application to the department for registration in the prescribed format along with the prescribed details and documents:-
(a) Industries mentioned in Schedule-1 requiring permission,
(b) Industries to be set up with foreign investment,
(c) Industries related to the subjects mentioned in Schedule-5 of the Constitution of Nepal,
(d) Industries having jurisdiction over two or more provinces,
(e) Uses related to academic consulting services related to diplomatic affairs.
(2) Apart from the industries mentioned in sub-section (1), the work related to industry administration including registration, renewal and regulation of industries will be done by the respective provincial government. But in the case of industries that require permission, permission will have to be obtained.
(3) Notwithstanding anything written in sub-section (2), in relation to the industry registered, renewed and regulated by the state government, the association shall perform the work related to the industry administration including the registration, renewal and regulation of such industry until the relevant state government regulates by law.
(4) Notwithstanding anything contained in sub-sections (1) and (2), industries related to atomic energy (atomic energy), radioactive materials (radioactive materials), industries related to nuclear applications and uranium-based applications shall be established and operated by the Government of Nepal only. .
(5) When making an application according to sub-section (1), the details or documents to be attached with the application can be submitted through electronic means (online) and the verification of the related documents can be done through electronic signature.
(6) If it is found that the necessary details and documents are not complete while examining the application received according to sub-section (1), the above registration body shall immediately inform the applicant of a maximum period of ninety days to submit the details or documents.
(7) If the applicant does not submit the details or documents requested in accordance with sub-section (6) or if the procedure in accordance with this Act or the regulations made under this Act is not completed, the above registration body shall disclose the reason.The application for industry registration may be rejected. If there is a decision to reject it, within five days of the decision, the written information should be given to the concerned applicant with the reason.
(8) A person, firm or company wishing to establish an industry other than those mentioned in sub-section (1) shall submit an application to the industry registration body of the respective province for industry registration along with the details and documents as provided in the provincial law.
