: (1) The Government of Nepal may publish a notice in the Nepal Gazette and constitute the following Debt Recovery Tribunal :-
(a) A gazetted second class official of Nepal Justice Service who has qualified to be a district court judge - Chairman (b) A person with three years of experience as a gazetted second class officer in the Government of Nepal, Nepal Administration Service who has passed at least a master's degree in cooperative, economics or management - Member ( c) A person who has passed an equivalent examination of Chartered Accountancy or obtained at least a master's degree in management and obtained at least 'B'-category auditor's certificate and has at least three years of experience in auditing - Member
(2) According to clause (a) of sub-section (1), the Judicial Service Commission shall be consulted before appointment to the post of chairman.
(3) The term of office of the Chairman and members of the Debt Recovery Tribunal shall be three years and they may be re-appointed for one more term.
