Section 65
Aiding and abetting the commission of an offense
: Aiding and abetting the commission of any offense mentioned in this paragraph shall be deemed to have been committed.
(1) In the event that a person under the jurisdiction of this Act commits offenses under Sections 38 to 65 and the said offenses are among soldiers, if a person under the jurisdiction of this Act commits the following offenses, the related case shall fall under the jurisdiction of another court:-
(a) Murder,
(b) Rape.
(2) Persons accused of being involved in the offense under sub-section (1) shall be handed over to the commanding officer or husband of the place where such persons are working, or to the authority or officer requested by the concerned officer, if there is an order of the investigating agency or investigation officer in that regard. Even if a person is retired or a fugitive, there will be no hindrance to investigate and take action according to the prevailing laws.
(3) A person under the jurisdiction of this Act who is under investigation within the jurisdiction of another court shall be automatically suspended for the duration of his imprisonment and until the final judgment of the case in the court.
(4) In the case of a person falling under the jurisdiction of this Act, even if an investigation has been started for a crime under the jurisdiction of another court, nothing in this section shall be deemed to prevent the formation of a Court of Inquiry and the taking of necessary action against such person.
