- If someone commits the following acts, he will be deemed to have committed an offense under this Act:-
(a) Importing plants, plant produce, biological control agents, beneficial insects or soil without obtaining an entry permit except as otherwise provided in this Act.
(b) importing plants or plant produce, biological control agents, beneficial insects or soil without a health certificate,
(c) In case of violation of any order or condition prescribed in accordance with this Act or the rules made under this Act,
(d) importing or importing infected plants or plant produce,
(e) knowingly or negligently bringing an infected plant, plant produce or other thing into contact with a healthy plant, plant produce or other thing,
(f) in case of distribution for sale of infected plants or plant produce,
(g) If the importer destroys infected plants, plant produce or other goods without submitting the prescribed procedure,
(h) if infected plants, plant produce or other articles are removed from the quarantine place without the approval of the Inspector or Head of Office,
(j) If any plant or plant produce biological control agent, beneficial insect or soil is introduced or imported from any other entry point other than the specified entry point,
(j) If he does not allow or obstructs the search, inspection or collection of samples in accordance with this Act and the rules made under this Act, or (k) If the inspector acts in a way that disturbs him while using the powers obtained under this Act.
