(1) Only after a person has been found guilty by the court of any offense in accordance with the law, the court shall determine the punishment of such person in respect of such offence.
(2) When determining the punishment according to sub-section (1), the determination shall be completed within thirty days of the conviction. "But while determining the following offense, the punishment for the offender should be determined:
(a) Offenses punishable by fixed points of imprisonment or fine under the prevailing law,
(b) An offense punishable with imprisonment for a term which may extend to three years or a fine which may extend to thirty thousand rupees,
(c) According to sub-section (1a) of section 145 of the Code of Criminal Procedure, an offense punishable by life imprisonment has been proposed.
