Section 22
Executive Director
(1) There shall be an Executive Director to act as the administrative head of the Authority.
(2) The Government of Nepal shall appoint the Executive Director on the recommendation of the recommendation committee under sub-section (3). (3) To recommend the appointment of the Executive Director, there shall be a recommendation committee as follows M-
(a) Member of the National Planning Commission (looking after concerned area) – Coordinator
(b) Secretary, Ministry of Industries - Member (c) One member appointed by the committee from among experts who have worked in the field of industry, commerce, trade, revenue administration, law, engineering or management. (4) The recommendation committee as per sub-section (3) selects on the basis of open competition from among the persons who have at least ten years of experience in the field of industry, commerce, trade, revenue administration, engineering or management with at least a master's degree in management, economics, engineering or law from a recognized educational institution. will recommend the names of three people to the Government of Nepal to be appointed as Executive Director.
(5) The term of office of the Executive Director shall be four years and if his work is found to be satisfactory, the Government of Nepal may appoint him to the post of Executive Director for one more time on the recommendation of the recommendation committee as per sub-section (3).
(6) Notwithstanding anything written in sub-section (5), if it is found that the executive director has not fulfilled his official responsibilities or has taken any action contrary to the interest of the authority, the Government of Nepal may remove him from the position of executive director at any time. However, he will not be deprived of a reasonable opportunity to submit an explanation before being removed from office.
(7) The executive director's remuneration, facilities and other conditions of service shall be as prescribed.
