Rule 5
Schedule to be prepared

(1) Before preparing the environmental study report, the proponent shall prepare an agenda in the following format:-
(a) As per schedule-6 related to brief environmental study,
(b) According to schedule-7 related to preliminary environmental testing,
(c) According to schedule-8 related to environmental impact assessment.
(2) The agenda prepared as per sub-rule (1) shall be submitted by the proponent to the following body for approval:-
(a) Work list related to the environmental study of development and construction work as per clause (a) of sub-section (2) of section 3 of the Act - concerned ministry of the Government of Nepal,
(b) If there is a task list related to the environmental study of the development construction work or project according to clause (b) of sub-section (2) of section 3 of the Act, the body designated by the provincial law,
(c) According to section (c) of sub-section (2) of Section E of the Act, among the works or projects related to development, brief environmental study or preliminary environmental test, if there is a work list related to the local law, and if there is a work list related to environmental impact assessment, the provincial government prescribed by the state law. entity.
(3) In the case of a proposal that requires an environmental impact assessment while preparing the agenda in accordance with this rule, the proponent shall also prepare it based on the zoning report approved in accordance with rule 4. However, the proposer can prepare a zoning report and work list and submit it for approval at the same time. (4) In accordance with sub-rule (2), such body shall give its opinion after making the necessary investigation on the submission of the action list related to environmental: impact assessment. including sub-rule (6) or (8) of rule 4 within fifteen days should be sent before the BMOJIS body.
(5) In the case of a brief environmental study or preliminary environmental test in the case of a work list in accordance with sub-rule (2) or (4), the agency as per sub-rule (2) and in the case of a work list related to environmental impact assessment, subThe body according to rule (4) shall, after conducting the necessary examination and if deemed necessary, approve such work list within fifteen days from the date of receipt of such work list as submitted or amended as necessary.
(6) For the purposes of sub-rule (5), counting days shall be counted from the date of receipt of such document in case of request for additional documents and in case of written clarification on any matter, from the date of clarification on such matter.
