Rule 4
Area to be determined
(1) The proponent shall determine the area according to sub-section (1) of Section 5 of the Act before preparing the environmental impact assessment: report.
(2) For the purpose of sub-rule (1), the proposer shall provide written suggestions within seven days to the local level where the proposal will be implemented and the concerned bodies, individuals or organizations in that area regarding the impact that the implementation of the proposal may have on the environment, in the format as per Schedule-4, the office of such local level, In the educational institutions, health institutions and any public place in that area, a notice should be prepared and a bond should be prepared and the notice according to the same should be published in one of the daily newspapers of the national level or in their website if they have:
(3) According to sub-rule (2) - if someone suggests an opinion in relation to the publication of the notice, within the time limit as per the sub-rule - the relevant proposer can suggest the opinion.
(4) The proposer shall prepare a zoning report in the format as per Schedule-5, mentioning the suggestions received as per sub-rule (3) and the impact on the environment from the implementation of the proposal.
(5) After preparing the report as per sub-rule (4), the proponent shall submit the zoning report related to the following project to the following body:-
(a) If there is a zoning report related to the work or project related to development construction as per clause (a) of sub-section (2) of section 3 of the Act, the concerned ministry of the Government of Nepal,
(b) In the case of zoning report related to development works or projects as per clause (b) and (c) of sub-section (2) of section 3 of the Act, the body prescribed by the provincial law.
(6) In relation to the report submitted in accordance with clause (a) of sub-rule (5), the concerned ministry of the Government of Nepal shall send it to the ministry within fifteen days with a recommendation for its approval, after making the necessary investigations and mentioning its opinion.
(7) According to sub-rule (6): On receipt of the zoning report, the MinistryAfter considering the received report and the attached documents, if necessary, the report shall be approved within fifteen days from the date of receipt of the report as submitted or amended as required.
(8) In relation to the report submitted in accordance with Clause (b) of sub-rule (5), the body prescribed by the provincial law shall carry out the necessary investigation and also mention its opinion in this regard: within fifteen days with the recommendation for the approval of the report before the body for approving the environmental impact assessment report prescribed by the provincial law. (9) Upon receiving the zoning report in accordance with sub-rule (8), the agency that approves the environmental impact assessment report prescribed by the state law shall approve such report within fifteen days from the date of receipt of the report as submitted or amended as required, if deemed necessary while studying the report.
(10) For the purposes of sub-rules (7) and (9), days shall be calculated from the date of receipt of additional documents for requesting additional documents and for sending a written clarification on any matter: from the date of clarification.
