Rule 99
Arrangements for getting work done by non-governmental organizations

(1) According to section 46 of the Act, in order to get work done by a non-governmental organization, a rough estimate of the need, type, time period, quality of work, manpower, work operation method and scope of work and the amount required should be prepared.
(2) The public body shall give a period of at least fifteen days to non-governmental organizations registered in accordance with the prevailing law and included in the existing list as per Rule 18 with the intention of carrying out such work up to ten lakh rupees, by publishing a notice in a national or local daily newspaper and a proposal from that organization. (3) "In the notification according to sub-rule (2), the following things should be disclosed:-
(a) The name and address of the public body calling for proposals,
(b) Nature, quantity or other necessary details of the proposed work,
(c) the place where the proposed work is to be done and the period during which it is to be completed,
(d) Last date and place for filing the proposal,
(e) Format of proposal,
(f) Documents to be submitted by the offeror with the offer,
(g) Payment Terms and Taxes, and
(h) Other matters deemed necessary by the Public Procurement Monitoring Office.
(4) The public body shall prepare an open bond in the name of the proposer for the proposals received in accordance with the demand under sub-rule (2).
(5) The evaluation committee shall recommend to the public body for approval the proposal of the proposer who offers the minimum amount after meeting the scope conditions as per sub-rule (1).
(6) If the proposal recommended in accordance with sub-rule (5) is deemed suitable, the public body shall accept such proposal and give notice to the relevant proposer to come to the agreement, and if he/she is present on such date, the agreement shall be concluded with him/her.
(7) If the proposer who has been notified as per sub-rule (6) does not come to enter into the contract, then he shall enter into a contract with the proposer who offers the lowest amount after fulfilling the scope conditions as per sub-rule (1)will end.
(8) Regardless of what is written elsewhere in this rule, in order to carry out work with an estimated cost of more than ten million rupees, the process of procurement of consulting services shall be followed by openly requesting a letter of intent in accordance with rule 70.
