Rule 104
Procedure to be followed by the Inquiring Officer

(1) The investigating officer shall have the authority to conduct the departmental investigation by following the following procedure:-
(a) The same powers as the court has in the matter of taking statements, filing written evidence and recording, issuing, etc. in the name of witnesses.
(b) Evidence to be heard on the record of the accused employee.
(c) To give an opportunity to the accused employee to cross-examine the witness and file evidence against the accusation.
(2) After the completion of the investigation work as per sub-rule (1), the investigation officer shall submit a report to the authority having authority to issue orders. In such a report, he has to file his judgment along with the reason for the punishment as well as the proof of the incident.
