Rule 98
Procedure to be followed by Inquiring Officer

(1) The investigating officer under sub-section (2) of section 88 of the Act shall have the right to conduct departmental investigation by following the following procedure:-
(a) To take statements, to file written evidence and to issue subpoenas in the name of witnesses, etc. to exercise powers similar to those of the court.
(b) To understand the evidence in the case of the accused employee.
(c) To give an opportunity to the accused employee to cross-examine the witness and file evidence against the accusation.
(2) After the completion of the investigation work as per sub-rule (1), the investigating officer shall submit a report to the officer authorized to order departmental punishment. In such a report, he has to file his judgment along with the reason for the punishment as well as any evidence.
