Section 5
Complaint can be filed if complaint or notice is not registered

(1) If the relevant police office refuses to register the complaint application or information given in accordance with sub-section (1) of Section 4, the person making the complaint application or information shall open such a complaint to the relevant District Public Prosecutor's Office or the police office of a higher level than the police office where such complaint application or information is to be registered. Complaints can be filed with the police office with a complaint or notice.
(2) If a complaint under sub-section (1) is received, the relevant District Public Prosecutor's Office or the Police Office shall keep a record thereof and send such complaint or notice to the concerned Police Office for necessary action.
(3) The relevant police office shall register and take action against the complaint received in accordance with sub-section (2) in accordance with sub-section (3) of section 4.
(4) If the office or officer mentioned in that sub-section refuses to register the information as per sub-section (7) of section 4, the person giving such information may file a complaint with the Chief District Officer of the concerned district along with the notification of the offence. But the Chief District Officer has been designated as the investigation officer and if he refuses to register such information, such a complaint can be filed with the Ministry of Home Affairs.
(5) If a complaint is received in accordance with sub-section (4), the relevant chief district officer or the Ministry of Home Affairs shall decide whether or not to register the information within three days and instruct the relevant office to do so.
(6) After receiving the instruction as per sub-section (5), the concerned office or officer shall take action according to that instruction.
