Section 15
<br> capable of removing organs from the body of a living person
Subject to other provisions written in this Act, only in the following cases, an organ may be removed from the body of a living person (donor) and transplanted into the patient's body.
(a) At least two concerned physicians have certified that any part of the patient's body has been destroyed beyond function and it is necessary to transplant another part of the patient's body in place of the destroyed part of the patient's life,
(b) The donor has given written permission to voluntarily donate an organ to a patient as per Clause (a) with the consent of his close relative, but in the case where there are no two close relatives of a donor, written permission to voluntarily donate an organ can be given with the consent of one close relative.
(c) The donor who voluntarily consents to organ donation in accordance with Clause (b) has attained the age of eighteen years,
(d) At least two relevant doctors have certified that the donor will not die immediately and will not be permanently disabled due to the removal of one of the paired body parts of the donor who has given approval in accordance with clause (b).
(e) It has been certified by at least two relevant doctors that the tissue to be taken from the donor's body can regenerate.
(2) Subject to other provisions written in this Act, if at least two relevant doctors certify that any tissue can be regenerated in the body of a person who has not completed the age of eighteen years, this section shall not be deemed to have created any obstacle to remove the said tissue from the body of such a person.
(3) This section shall not be deemed to prevent the removal of non-functioning parts of a person's body in the course of treatment.
(4) According to clause (b) of sub-section (1), the procedure for granting consent and approval shall be as prescribed.
(5) The grantor may withdraw the approval given under clause (b) of sub-section (1) if he wishes.
(6) If the donor withdraws the approval according to sub-section (5), the person receiving the organ shall not be entitled to claim any kind of compensation from the donor.
