(1) Employees may form a trade union subject to this Act. (2) When forming a trade union in accordance with sub-section (1), the following provisions shall be followed:-
(a) Except for the officer-level employees and doctors who have to work as the head of the office, the employees of the eighth level or below can form a trade union of national level employees for the benefit of their professional rights and take membership.
(b) The registration of the TED union of the employees will be in the Department of Labor and Employment Promotion.
(3) The formation of the official TED Union shall be as follows:-
(a) The employees may form an official trade union with officials chosen by the members of the employees' trade union formed in accordance with sub-section (1).
(b) The official TED union of the employees will be allowed to conduct social dialogue and collective bargaining by presenting their professional demands to the relevant bodies at the district level, departmental level and national level. In the event that the official TED union of the employees is not formed, the TED union and associations of the employees formed according to sub-section (1) shall receive collective bargaining rights by mutual agreement. (4) The work, duties and rights of the trade union shall be as follows:-
(a) To provide constructive suggestions and support to the Government of Nepal to make health services effective and dynamic by protecting and promoting the rights and interests of employees,
(B) Conducting various kinds of meetings, trainings, seminars and other creative and creative activities,
(c) Forming a federation, becoming a member of it, becoming a member of an international association or federation and representing on behalf of their organizations.
(5) The Government of Nepal may take the advice and suggestions of the official TED union of employees while formulating laws related to health services.
(6) If there is a request from the designated officials of national level trade unions and official trade unions to be transferred to a place suitable for their area of ​​work, the authority will agree to the same.Arrangements will have to be made to transfer.
(7) The central officials and executive members of the national level TED Union can be arranged to work up to 30 days in a year to participate in domestic and foreign seminars, conferences, conventions, organization-related activities, etc., without hindering the scheduled service work and without incurring any financial liability to the Government of Nepal.
(8) The registration of TED Union will not be done at the level of employees. However, TED Union officially registered according to the Nepali Civil Service Act, 2049 before the commencement of this section shall be deemed to be registered under this Act.
(9) The registration of TED Union, related conditions and procedures and other provisions shall be as prescribed.
