Section 49
Cases falling within the jurisdiction of the lower and upper courts should be heard by the upper court
According to the prevailing law, a case related to an offense falls within the jurisdiction of both the lower and upper courts or a person or offense related to a person who can be jointly prosecuted under section 54 of the lower and upper levels. If the case can be filed within the jurisdiction of both the courts or if it is filed, the higher court will have the right to hear such case.
