Section 9
Inform about the start of industrial operation, commercial production or business
(1) An industry registered in accordance with this Act shall commence the operation of the industry, its commercial production or business within the period mentioned in the industry registration certificate and shall inform the industry registration body within thirty days.
(2) If an industry is unable to operate the industry or start its commercial production or business in accordance with sub-section (1), the reason for this may be to apply to the industry registration body for an extension of such period at least thirty days before the end of the period mentioned in the open industry registration certificate, as prescribed.
(3) If the application cannot be made within the period as per sub-section (2), the basis and reason thereof shall be disclosed within the period mentioned in the industry registration certificate or within six months from the date of expiry of the said period, and an application may be made before the industry registration body by paying the prescribed delay fee.
(4) If the application received under sub-section (2) or (3) is examined, if it is deemed appropriate to establish the industry, the progress of the work including the construction work to be done for the establishment of the industry and the nature of the industry, the industry registration body shall determine the period for starting the operation or commercial production or business of such industry. (5) If the period is extended according to sub-section (4), the related industry shall start the operation of the industry, its commercial production or business within that period.
(6) According to sub-section (4), if the period for starting the operation or commercial production or business of an industry has not been extended, written information shall be given to the concerned applicant within seven working days of such decision.
(7) According to sub-section (4), if the period for starting the operation or commercial production or business of any industry cannot be extended, the registration permission granted to such industry shall be automatically deemed to be inactive.
