(1) If any person does any act contrary to this Act or the rules made under this Act or the order or direction or circular or notification issued thereunder or any procedure prescribed by the Bank, the foreigner concerned with the offense committed for doing that act. After confiscating the exchange, such a person will be fined from the above fine up to three times the above fine. However, in relation to the offenses in which the foreign exchange related to such offense cannot be confiscated, the foreign exchange related to the offense shall be fixed and the fine shall be increased from the fine up to three times the amount of the offense.
(2) In the case of failure to disclose or cannot disclose the amount of the defect while maintaining the defect according to sub-section (1), a fine of up to two lakh rupees will be imposed depending on the amount of the defect.
(3) If the employees assigned to carry out, inspect and investigate the work matters according to this Act do any act that violates the Act or violate confidentiality, the employee who commits such an act shall be fined up to one lakh rupees depending on the amount of the offense.
(4) If the offense punishable under this Act is committed by a firm, company, or organization, the director, officer, employee, or agent of that firm, company, organization, who is in charge of the work related to the offense at the time of the offense, shall be a party to the punishment. However, if such directors, officers, employees or agents were not aware of the fact that the offense had been committed, or if they can present evidence that they have tried as much as possible to prevent such offence, they shall not be liable for the punishment according to this sub-section.
(5) In accordance with Section 8, the importers who have imported the goods without doing the work or the procedures to be carried out, or who have not imported the goods within the prescribed period, or who have not imported the goods to be imported, shall be subject to the relevant import defect. (9) Notwithstanding anything else written in this section, if the gross amount of the offense related to foreign exchange is one crore rupees or more, in addition to the other punishments to be inflicted on such person, the imprisonment of up to three years shall also be added.
(10) The person arrested by the investigating officer in connection with the investigation and the accused person in connection with the case by the concerned court, in the case of offenses with the amount of the offense up to one lakh rupees, on appearance bail, and in the case of offenses with the amount of the offense exceeding one lakh rupees, the bail is taken according to the amount of the offense or fixed according to the amount of the offence. He can take the bond as mentioned above and keep it on the date.
(11) If any person holding the office of head or member of any constitutional body or political appointee commits an offense under this Act, he shall be punished twice as much as any other person who commits such an act. But in the case of imprisonment, the punishment will not be more than two years.
(12) According to sub-section (10), the person who does not file the bond shall be detained and prosecuted.
