Rule 3
Applying for party registration
(1) In order to register a party formed in accordance with Section 3 of the Act with the Commission, in accordance with the decision of the Central Committee of such party, the party's chief officer shall submit an application to the Commission in accordance with Schedule-2, attaching the details and documents as per Section 5 of the Act, Subsection (1).
(2) For the purpose of clauses (d) and (e) of clause (d) and (e) of sub-section (1) of section 5 of the Act, when applying for party registration as per sub-rule (1), attach the commitment and proclamation as per Schedule-3 signed by at least five hundred Nepalese voters. will fall.
(3) In relation to the application submitted by the party according to sub-rule (1), the Commission shall examine as follows:-
(a) Disclosure or non-disclosure of what is required to be disclosed in the application,
(b) Whether the application and the attached details and documents are complete or not (c) Whether the conditions prescribed by the Constitution of Nepal and prevailing federal laws have been fulfilled or not.
(4) When the commission examines according to sub-rule (3), if the details and documents attached with the application submitted for party registration are not clear or if additional evidence is required on any matter, the concerned party shall be given a maximum of seven days to submit their written statement along with additional details, documents or necessary evidence. Time will give.
(5) Within the time given by the Commission according to sub-rule (4), the relevant party shall submit their statement in writing along with additional details, documents or evidence.
(6) Upon examination of the application, details, documents and evidence submitted for the registration of the party according to this rule, if it is found necessary to register the party, the Commission shall register the application within forty-five days from the date of registration of the party and if it is not found possible to register the party, it shall inform the applicant.
