Section 116A
Claim withdrawable

(1) In any case other than the case in which the Government of Nepal is the plaintiff, the party to the case abandons the claim he has made in the complaint, appeal or petition to withdraw the claim or withdraw the complaint, appeal or petition on the grounds that he cannot prove his claim or the purpose of the claim has ended. He can file an application in the court at any time before the judgment of the case.
(2) If a petition is received in accordance with sub-section (1), the court shall issue an order allowing the withdrawal of the complaint, appeal or petition in accordance with the petition.
(3) According to sub-section (2), if there is an order to withdraw the complaint, appeal or petition, the court shall deduct the costs of that case.
(4) If a person withdraws a complaint, appeal or petition in accordance with this section, the same person cannot file a complaint against the person who has been opposed in such complaint, appeal or petition.
