Rule 76
Asking for details or giving an order to the Damasahi businessman
(1) In connection with the appointment of an investigating officer, restructuring manager or liquidator to a business owner, the court may demand from him the details of the action plan as follows:
(a) the remuneration expected by the groomer for carrying out the prescribed work and the basis thereof,
(b) Details and time period for completing the specified work with action plan,
(c) The number of employees required to complete the action plan, their salaries and expenditure details including administrative costs,
(d) Other details deemed necessary by the bench considering the nature of marriage.
(2) According to the action plan submitted by the court, the damasahi practitioner appointed by the court shall complete the work within the period determined by the court in accordance with sub-section (2) of section 22 of the Damasahi Act, 2063. If the period granted by the court needs to be extended, the basis and reason for it should be submitted to the court.
(3) If the grounds and reasons mentioned in the report received in accordance with sub-rule (2) are reasonable, the court will extend the period.
(4) It shall be the duty of the Damasahi businessperson to submit the report to the concerned court every three months on whether the work has been done according to the details and action plan as per sub-rule (1).
(5) As far as possible, the reports received under this rule should be submitted to the pre-ordering bench by taking them to Damasahi for hearing.
(6) After hearing the report submitted in the process of Damasahi, the Commercial Bench will issue necessary instructions and it will be the duty of the Damasahi businessmen to comply with such instructions.
(7) The Commercial Court may also invite the relevant regulatory bodies as necessary during the hearing of the Damasahi case.
