Section 13
Functions, Duties and Rights of the Corporation
: (1) It shall be the duty of the Corporation to provide safe, efficient, orderly, cost-effective and appropriate air transport services throughout or outside of Nepal, subject to this Act and the rules made under this Act. The Corporation will be able to use its rights to develop the air transport service in a way that will be more beneficial and to make the service accessible at reasonable fares.
(2) Without prejudice to the generality of the rights conferred by sub-section (1), the Corporation may exercise the following powers in particular:
(a) operating any air transport service or flying an aircraft for commercial or other purposes and doing all the work related to air services,
(b) to arrange for teaching and training in the flying of aircraft and all kinds of work related thereto to persons desirous of being appointed to the Corporation or to any other persons,
(c) If necessary, to obtain the assistance and services of aviation organizations outside Nepal with the prior approval of the Government of Nepal to carry out any work related to air services that the corporation is allowed to do under this Act,
(d) Acquiring, enjoying, holding, selling, transferring and doing any other work related to air transport, movable and immovable property, (e) manufacture, repair and manufacture of aircraft, vehicles or other spare parts for himself or any other person,
(f) to execute all such contracts and leases as may assist in the exercise of their rights and in the performance of their duties under this Act,
(g) acting as agent and contractor in matters relating to air transport services operated by any other person,
(h) Any person engaged in air transport shall agree with the corporation to operate air transport services on behalf of or in conjunction with the corporation, (i) To collect fares and other prescribed duties for passengers carried by the air transport services operated by them with the prior approval of the Government of Nepal,
(j) With the prior approval of the Government of NepalTo determine fares for goods carried by air transport services operated,
(k) Development of feeder service and improvement of various types of aircrafts used in air transport services and taking necessary steps to develop air transport services operated by the Corporation within or outside Nepal,
(l) To do any work that is in the interest of the corporation or to do necessary work for the provision and improvement of any transport service by water or land related to the air transport service operated by the corporation and service facilities such as restaurants, rest houses, hotels, goods warehouses, and
(d) To do all the things necessary and convenient for the performance of the duties and exercise of the rights conferred by this Act.
(3) By anything contained in this section –
(a) authorizes the Corporation to contravene any Nepal law for the time being in force, or (b) No person shall be deemed to be entitled to take any action against the corporation or its employees in respect of any duty not otherwise to be performed or any liability not to be borne by them.
