Section 165
Procedure for payment of private damages or compensation
(1) The compensation or any other amount to be paid by a person according to the judgment of the court shall be submitted to the person who is to be paid according to the judgment within six months of the judgment.
(2) If such person does not pay such damages, compensation or amount within the period as per sub-section (1), he will be fined up to ten thousand rupees.
(3) If the person who is required to pay such damage, compensation or such amount fails to pay within the period as per sub-section (1), the person who will receive such damage, compensation or payment of such amount may file a petition showing the property of the person who is required to pay such damage, compensation or amount within three years from the date of the final judgment.< br> (4) If an application is received according to sub-section (3), the court shall seize such property and sell it at auction and pay damages, compensation or such amount respectively.
(5) According to sub-section (1), if the person who is required to pay compensation or amount pays such amount to the court or if any amount has been pledged or bailed in accordance with sub-section (1) of section 68, if the compensation, compensation or such amount is recovered from it, then the payment shall be made accordingly. will fall.
(6) If the person who is entitled to compensation, compensation or other amount cannot locate the property within the period as per sub-section (3), the court shall keep such petition in order that the person who is to receive the compensation or other amount will be paid when such property is found.
(7) If the loss, compensation or any other amount is not recoverable as per subsection (4), the person entitled to pay the remaining loss, compensation or other amount that is not recovered shall pay it to him within thirty days from the date of auction sale of the property of the offender or within thirty days when the application is pending as per subsection (6). He can file a petition to imprison.
(8) If an application is received as per sub-section (7), the court shall convert the arrears or amount due in that manner into imprisonment at the rate of three hundred rupees per day and imprison the person who has to pay such arrears or amount.
(9) In the case of the escape of a particular person while imprisoning a person in accordance with sub-section (8).Imprisonment cannot exceed two years and in the case of a public institution wholly or mostly owned or controlled by the Government of Nepal, the provincial government or the local level, imprisonment for more than four years. However, if the compensation is not met, the person can be imprisoned for up to four years.
(10) According to sub-section (8), if the amount is less than 300 rupees or if the amount remains, in case of imprisonment for personal loss, compensation or other amount, he shall be imprisoned for one day.
(11) The government of Nepal shall bear the direct expenses incurred in accordance with the law during imprisonment as per sub-section (8).
(12) Notwithstanding anything else written in this section, if it is found that the person liable to pay private damages, compensation or other amount has concealed or converted any of his property within the period referred to in sub-section (1) or (3), such property shall, notwithstanding anything written in the prevailing law, If discovered, such property will be confiscated and twenty-five percent of the confiscated property will be given to the person who discovered it, and the remaining amount will be paid from the remaining amount, and if there is any remaining amount, then the remaining amount must be returned to the concerned person.
