Section 22
Duties, Duties and Rights of the Inspection Officer
: (1) In addition to the duties, duties and rights written elsewhere in this Act, other duties, duties and rights of the Inspection Officer shall be as follows:-
(a) If there is probable cause that the licensee and the direct seller or distributor of goods are producing or selling and distributing unsafe, harmful or substandard goods, or if there is probable cause that any action is being taken against this Act or the rules made under this Act, to carry out necessary inspection or investigation in relation to such action,
(b) During the inspection or investigation as per clause (a), if it is found that any harmful or substandard goods are being produced or sold or distributed or any action is being taken contrary to this Act or the rules made under this Act or if there is a reasonable basis and reason for such action to be taken, such item Searching the place of storage and collecting samples of such articles,
(c) During the inspection or investigation as per clause (a) or during the search of the store as per clause (b), if it is found that any harmful or substandard goods are being produced or sold or distributed, or if action is being taken contrary to this Act or the rules made under this Act, such consumable goods for the specified period. (d) To submit the report related to the work done in accordance with clauses (a), (b) and (c) to the department within seven days.
(2) It shall be the duty of the licensee and the direct seller or distributor to provide the details or records as requested by the inspection authority during the inspection, inquiry or search according to this section.
(3) In accordance with sub-section (1), the procedure to be followed during the inspection, inquiry or search and other duties, duties and rights of the inspection officer shall be as prescribed.
