Section 15
Monopoly to operate scheduled (scheduled) air transport services
1) From the date specified by the Government of Nepal by publishing a notice in the Nepal Gazette, anyone other than the corporation or its cooperative shall enter Nepal or leave Nepal or go from one place to another in Nepal. It is not allowed to operate air transport services. Provided that nothing contained in this section shall limit the right of any person to:-
(a) Until the corporation is able to operate air transportation services as per the requirement in various places within or outside Nepal as deemed necessary by the Government of Nepal, if the Government of Nepal grants a license for a specified period to fulfill such requirement, the person who receives such license or the government of any foreign country and the Government of Nepal to operate the air transport service according to the agreement between them or to operate such air transport service for the duration of the agreement by entering into an agreement with the Government of Nepal before this Act came into force, or
(b) flying an aircraft with passengers for the primary purpose of imparting instruction in the duties and duties of the pilots of the aircraft or checking the aircraft by the controller, or
(c) conveying passengers and goods for the relief of any natural calamity, or
(d) Passengers flying from one airport or place without landing anywhere in between and landing at the same airport or place only for the purpose of recreational flying or aerial survey, fire fighting and spraying chemicals on crops, locust control or other similar aerial activities. And carrying goods.
(2) If any person, in contravention of this section, operates scheduled air transport, he shall for each offense be liable to a fine of Rs. 1,000.- (one thousand) or imprisonment up to one year or both. Explanation: For the purpose of this clause, each flight shall be treated as a separate offence. (3) The duration of the contract referred to in clause (a) of the restrictive clause of sub-section (1).After the payment, if there is a need to extend the term (period) again or if any person or company or the government of a foreign country needs to be allowed to operate a new air transport in any other way after this Act comes into force, the government of Nepal will take the opinion of the corporation and decide on the granting of the license.
(4) The Corporation should take the prior approval of the Government of Nepal to expand or carry out its work in more areas than the one approved by the Government of Nepal.
