Section 8
Appointment of Election Officer
(1) The Commission shall appoint one chief election officer in each district and one election officer in each constituency to carry out the work to be done in the election in accordance with the Constitution, this Act and the prevailing federal laws.
(2) When the Commission appoints an election officer in accordance with sub-section (1), in consultation with the Council of Justice, the district judge shall be appointed as the chief election officer and in consultation with the Judicial Service Commission, at least a gazetted second grade official of the Nepal Judicial Service shall be appointed as the election officer.
(3) Notwithstanding anything written in sub-section (1) or (2), if the election date is set so that the election of the members of the House of Representatives and the members of the Provincial Assembly are held on the same date, the Chief Electoral Officer appointed for the election of the members of the House of Representatives shall also be responsible for the election of the members of the Provincial Assembly. The election officer appointed as an officer and member of the House of Representatives will be appointed to work as an election officer in the respective constituencies of the Provincial Assembly.
(4) The Election Officer may appoint Assistant Election Officers and other employees in the number specified by the Commission.
